Legislative Agenda

ICADV

2008 Legislative Agenda

Leadership Issue

This level of involvement allows ICADV's Legislative Committee to draft legislation, find sponsors, and/ or fully participate in developing and implementing legislative and/ or administrative strategy.

Indiana Confidentiality Statute:

ICADV will actively support legislation that updates IC 35-37 Confidential and Privileged Communication law to reflect current state and federal laws.

Crime Victims Compensation Fund:

ICADV will actively support the change of language in the Crime Victims Compensation fund. Currently the Violent Crime Compensation Fund will only award funds to an "unmarried" victim or family member for burial, funeral or cremation expenses.

Stalking and use of GPS:

ICADV will actively support a Resolution to study the use of electronic monitoring and monitoring devices as a means of stalking.

Limited Involvement

This level of involvement allows ICADV's Legislative Committee to testify and write testimony when requested.

No Contact Orders-Violation I.C. 35-33-8-3.2

ICADV will support legislation brought forth by the Indiana Prosecuting Attorney's Council's to amend IC 35-33 as follows:

  • As a condition of release under I.C. 35-33-8-3.2 a court may:
  • "(4) require the individual to refrain from any direct or indirect contact with an individual."
Need similar provision for those that are not released

Mandatory Hold:

ICADV will support legislation that requires a mandatory hold or "cooling off period" for individuals arrested for a crime of family violence.

Monitoring

This level of involvement allows ICADV's Legislative Committee to disseminate information, watch and report on the progress of an issue or piece of legislation.

ICADV will monitor any and all pieces of legislation that can impact domestic violence, sexual assault and stalking victims which includes but is not limited to the following:

Stalking I.C. 35-45-10:

Relax "actual fear" requirement for victims under a certain age

2005 Legislative Agenda

Leadership Issue

This level of involvement allows ICADV's Legislative Committee to draft legislation, find sponsors, and/ or fully participate in developing and implementing legislative and/ or administrative strategy.

Domestic Violence Funding:

ICADV will actively support legislation that maintains $2 million in domestic violence funding through the Indiana general budget.

Issuance and Revocation of Gun Permits:

ICADV will actively support legislation that prohibits individuals who are subject to Order of Protection or are convicted of domestic battery from obtaining a gun permit from the Indiana State Police and the revocation of active permits from such individuals.

Crime of Domestic Battery:

ICADV will actively support legislation that will increase penalty for domestic battery to a D Felony if it results in bodily injury to the other person, and if the person who commits the domestic battery has a previous, unrelated conviction under current Indiana statute, or has a conviction under a substantially similar statute in another jurisdiction.

Changes to the Indiana Protection Order Statute:

ICADV will actively support legislation that will:

  • Add language that a Sheriff's Department or civil process servers cannot charge a service fee for foreign orders ·
  • Clarify the return of confiscated weapons and ammunition; limitation on liability ·
  • Allow courts to issue a search warrant authorizing law enforcement officer to seize any deadly weapons, firearms, or ammunition specified in an Order of Protection

Limited Involvement

This level of involvement allows ICADV's Legislative Committee to testify and write testimony when requested.

Sentencing Structure:

ICADV will support legislation that includes aggravating penalties for children witnessing domestic violence.

Monitoring

This level of involvement allows ICADV's Legislative Committee to disseminate information, watch and report on the progress of an issue or piece of legislation.

Monitor any other items of interest.

2004 Legislative Agenda

Leadership Issue

This level of involvement allows ICADV's Legislative Committee to draft legislation, find sponsors, and/ or fully participate in developing and implementing legislative and/ or administrative strategy.

Cruelty to Animals:

ICADV will actively support any legislation that requires persons convicted of "Cruelty to Animals" to undergo evaluation for domestic violence.

DV Fatality Review:

ICADV will actively support any legislation to change the technical language of HEA 1431 (Domestic Violence Fatality Review Team). Specific language to be changed includes the team member list, further clarification of cases to be reviewed, and clarification of final judgment.

Domestic Violence Prevention and Treatment Fund:

ICADV will actively support any legislation to increase the DVPT fee from $50 to $100. ICADV will also actively support any legislation to broaden and update the relevant definitions and conditions in the statutes concerning the DVPT fund.

Early Release from Prison:

ICADV will actively support any legislation that prevents a person convicted of a crime of domestic violence from being eligible for early release from prison or jail due to overcrowding.

Limited Involvement

This level of involvement allows ICADV's Legislative Committee to testify and write testimony when requested.

Safe Housing for Victims of Domestic Violence:

ICADV will support any federal legislation to prevent landlords from evicting victims of domestic violence for crimes committed by their batterer, under the federal "one-strike" policy.

Monitoring

This level of involvement allows ICADV's Legislative Committee to disseminate information, watch and report on the progress of an issue or piece of legislation.

Possession of Firearms:

ICADV will monitor all issues that may prevent persons convicted to a crime of domestic violence from possessing a firearm.

Interference with Emergency Communication:

ICADV will monitor any legislation that would make the crime of "interference with Emergency Communication" a stand-alone crime.

Monitor any other items of interest.
